CONDITIONS OF SALE OF THIS SITE

All product orders establish a contractual relationship with the ProBro AG. The corresponding contract terms and conditions include this use and sale as well as the Privacy Policy and Cookie Policy. This usage and sale conditions apply to all offers and contracts in relation to the sale and delivery of articles from ProBroWear and you agree to these terms and conditions of use and sale when you order ProBroWear article on our website, use other ProBro services, accept  an order from ProBroWear or otherwise access our website in any form. ProBro AG reserves the right to appoint representatives of ProBroWear  for the purposes of implementing possible actions in compliance with such a treaty. On this website, the term "PROBROWEAR" refers to ProBro AG or ProBroWear.

TERMS OF SALE

Use of this website, these terms of use and sale, in conjunction with all regulations mentioned therein, our communication with you and the validity and implementation of the contract for the purchase of articles shall be exclusively subject to Swiss law. Any disputes relating thereto shall be submitted exclusively to courts present in Switzerland and are finally settled by these. The application of the United Nations Convention on Contracts for the International Sale of Goods (UN sales law) is excluded. To place an order you must be at least 16 years old. Purchase orders can only be placed as a customer and not as a reseller. They ensure that the information you provide are complete and correct. in the ordering process is the ability to capture a company address, but this is only for shipping purposes. A purchase agreement is only between the seller PROBROWEAR and a private person as a buyer. It must be a civic personal name recorded, because we do not sell to legal persons. Consequently, no invoice is created especially for a legal person but for a private person.

CONCLUSION OF A CONTRACT

All information on this website and in our messages that relate to PROBROWEAR articles, products and services are regarded merely as an "invitation". Information shall not be used as an offer or contract. PROBROWEAR is entitled to consider or refuse an order for any reason. If your order of PROBROWEAR was not accepted within 10 days, the order will be considered as rejected. A rejection can occur for example, when the procedure fails "Pre-Authorisation" for the reservation of your products for shipment. After placing your order we will send you a message about the confirmation of your Order Number, calculated total sum and shipping information. Your order does not establish a contractual relationship between you and PROBROWEAR until you receive a message from PROBROWEAR that the articles you ordered have reached our shipping companies, which confirms the transport.

DO I NEED TO REGISTER FOR SHOPPING AT PROBROWEAR?

A registration for online shopping at PROBROWEAR is not required. With us you can also place an order as a "guest". Further information can be found in our Privacy Policy. We recommend that you register online, because all the information we need to carry out an order will be stored automatically in your customer account. As a registered customer you can also view your order summary.

HOW DO I CREATE A CUSTOMER ACCOUNT?

To speed up and simplify the online shopping you can register on www.probrowear.com Simply click on the top of the website, click on "Register". If you use a public computer, we recommend that you close your browser at the end of your visit. Your information will be saved in our database. They are however not accessible from this computer to others. We recommend that customers create an account on our website. The advantages of a customer account with www.probrowear.com are the order overview and fast access to shipping and payment information by means of a user name and password. If you register as an online customer, we may ask for additional information. As an alternative to the customer account is the possibility to "guest". As a "guest" you will not have access to shipment tracking, order overview or the advantage of your payment and shipping information on our site.

HOW DO I CHANGE MY ACCOUNT?

With your E-mail address and a password of your choice you can in your customer account at any time add, delete or modify your data online.

 

WHAT DO I DO IF MY PASSWORD IS NOT WORKING?

If you have an existing PROBROWEAR account, at the top of the page, click "Register". Go to the login page where you can click on "Forgot your password". You will then be asked to give your e-mail address so we can send you a link to have your password changed for your safety.

CAN I SAVE MY PAYMENT/SHIPPING INFORMATION?

You can save personal data, including shipping and billing address, for future use. Further information can be found in our Privacy Policy.

HOW DO I PLACE AN ORDER?

You can place an order online on our secure website www.probrowear.com.

HOW CAN I USE THE ONLINE CHECK AVAILABILITY OF ARTICLES?

Once you have selected the part, you can determine which color/size is available. You must first select the product and then the size. If the required size is not listed for the selected color, that size is not available. PROBROWEAR strives to the latest and best styles, colors and sizes are available. However there can be stock shortages due to overwhelming demand for a specific style, color or size. On our website the inventory is displayed in real time, thus only available articles are displayed and are available for purchase.

HOW IS THE TOTAL SUM CALCULATED?

The total sum of the article includes the price of the article(s), taxes and additional charges for freight, delivery, shipping, commissions from third-party vendors such as PayPal, Master Card, Visa etc.

Reservation of ownership

The ordered items remain the property of  PROBROWEAR until all payments have been fully settled, including payment for late or partial deliveries.

HOW ARE THE CORRESPONDING TAXES CALCULATED IN MY ORDER?

The German value added tax is currently set at 19%, the Swiss Value Added Tax is 8%. The prices displayed on the articles website include VAT.

WHAT PAYMENT METHODS DO YOU ACCEPT?

PROBROWEAR accepts Visa and MasterCard credit cards and debit cards, Maestro debit cards and PayPal. Credit and debit cards must be issued by a German institute and must have a billing address in Germany. Please ensure that the billing address in the credit or debit card issuing bank is the same as when placing your order. We do not accept personal checks, post instructions*, or cash. Excluded are Swiss customers who can pay with Post E-finance.

WHERE ARE THE ADDITIONAL FEES FOR CREDIT CARD OR DEBIT CARD PAYMENT?

Since PROBROWEAR does not charge the shipping of the article, we use a process of "Pre-Autorisation" to reserve your article for shipping. To avoid unnecessary overdraft charges a method; which is often used at banks, called  "Pre-Authorisation" is used to check that the used credit/debit card is sufficiently covered. Please note that the transaction is recorded on your statement as "PROBROWEAR". Most of the authorizations expire within 5 to 7 days. However, the issuing bank determines the duration of the authorization. The final exposure of the credit or debit card only corresponds to the value of your shipped items plus the appropriate shipping costs and taxes. WHAT HAPPENS IF THE PAYMENT FAILS?

It could be that your billing address for your first payment does not match the shipping address. Please note that this requirement is only for your first order applies. After the first use of our services you can use different billing and shipping addresses. It is possible that your payment method is not accepted by us, as we are currently only Visa and MasterCard credit cards and debit cards, Maestro debit cards and PayPal. CAN I EXCHANGE AN ARTICLE?

On presentation of receipt, you have the option of exchanging unsuitable items within 14 days of purchase, provided that the product is in perfect condition, the labels were not removed from the clothing and the packaging is like new. The garments must be sent together with the receipt in its the original packaging to the following address:

Worn or washed clothes cannot be taken back. The return transport costs are to be borne.

WHAT SHOULD I DO IF I HAVE NOT RECEIVED AN E-MAIL CONFIRMATION?

With the creation of your customer account please confirm your E-mail address. If you use the email address from your workplace, please be aware that many companies spam filter to deter automated incoming mail. This could affect the delivery of our confirmation email to you or the mail could have been moved to the spam folder.

Shipping to a PO box is not possible worldwide.

HOW DO I TRACK MY ORDER?

If the consignment is not carried out in accordance with the shipping time, please contact SUPPORT.

 

WHAT MEANS "SHIPMENT PREPARATION"?

If your read message "Shipment Preparation" in your order, your order is prepared for dispatch or the tracking information has not yet been updated with the delivery company. It typically takes 2 to 4 working days until the shipping company receives our information.

CAN I CHANGE THE DELIVERY ADDRESS OR PRODUCTS FOR ORDER?

Due to the small time window between ordering and shipping, it is not possible to make changes after placing an order.

 

HOW CAN I CANCEL MY ORDER?

Because we process orders as quickly as possible, you cannot cancel a purchase order. However, please note that a change of your order is not possible, because the shipping process starts immediately after placing your order. If a cancellation of an order due is not possible, we try to offer alternative solutions. Please contact our customer service SUPPORT, so one of our staff members can help. However, if you receive an article in connection with an order which we could not cancel, you can return the article within the next 14 days. HOW DO I RETURN MY ONLINE ORDER?

We will give you a full refund (minus any shipping costs for the delivery of the article to you) within 14 days after receipt of the returned item. Please note that some restrictions apply. More about free return and return procedure from our customer service. 

Returning defective article: If an item is damaged or faulty, we wiil replace them at our discretion or refund the original purchase price in full (less any shipping costs for the delivery of the article to you). In addition we will refund the cost of returning to us damaged or faulty goods. For more on the return procedure from our customer service via E-Mail.

Optionally, the following restrictions apply:

A. For any reason within 14 days from the receipt of your order, the item can only be accepted if it is in resalable condition and the original label/Annex label was not removed. If the part is worn or damaged or is not in the original packaging, PROBROWEAR cannot accept the returned parts and cannot give you a refund.

All returns must have the original receipt and the delivery note with the completed form "withdrawal form" resolved, otherwise the PROBROWEAR will not accept returned parts and cannot give you a refund.

C). If the damage or failure of the article was caused by something other than the quality of the material or the manufacturing process, the article can be returned. Damage caused by misuse, improper use or abuse will not be refunded by PROBROWEAR.

To exercise your right to return and for the full refund you must send us your return intention in one of the following types of icommunication: E-Mail Support or withdrawal form.

 

WHERE DO I SEND MY ARTICLE BACK?

The exact address will be communicated to you by our customer service. Please refer to the E-Mail SUPPORT. article in your return must be included on the delivery note. Parts that are not on your packing slip and that are not originally purchased on www.probrowear.com, cannot be returned. We recommend insured shipping with consignment tracking for the return of your article, since PROBROWEAR bears no liability for the loss in transit. The reimbursement takes about 10 to 14 working days from receipt of the returned articles by PROBROWEAR. The back payment via bank transfer will follow. This is under the proviso that PROBROWEAR is obliged to reimburse costs only upon receipt of the returned parts.

 

HOW WILL I GET MY REFUND?

Your return is processed from the date on which you informed us about your intention of returning. You will receive your refund by bank transfer.
